These terms govern your use of the Spokes Dunedin online forum at spokes.nz. By using the Forum, you agree to these terms.
1. The Forum
The Forum is operated by Spokes Dunedin (“we”, “us”, “our”), an incorporated cycling advocacy organisation based in Dunedin, New Zealand. These terms apply only to use of the Forum, not to any other activities or services of Spokes Dunedin.
2. Your Account

You must create an account to participate in the Forum. You agree to provide a valid email address and keep it up to date.

You are responsible for all activity under your account. Contact us immediately if you suspect your account has been compromised.

You may close your account at any time by contacting us.

We may suspend or close your account if we reasonably believe you have breached these terms.
3. Your Content

You retain ownership of content you post (“Your Content”). By posting, you grant us a non-exclusive, royalty-free licence to store, display, and distribute Your Content on the Forum.

You represent that Your Content does not violate any law or infringe any third party’s rights.

We may remove or edit Your Content if we believe it violates these terms or applicable law.

If you delete Your Content, or if we remove it, the licence above ends once the content is removed from our active systems. Backups may retain copies for a reasonable period.
4. Acceptable Use
You must not use the Forum to:
- Break any New Zealand law
- Harass, abuse, or threaten others
- Post spam, advertisements, or unsolicited promotional content
- Impersonate another person or organisation
- Attempt to access another user’s account without permission
- Distribute malicious software or interfere with the Forum’s operation
5. Moderation
We reserve the right to moderate the Forum in our discretion, including editing, moving, or deleting content, and suspending or banning users. We are not obliged to monitor the Forum but may do so.
6. Disclaimer of Warranties
The Forum is provided “as is” and “as available” without any warranty, express or implied, to the maximum extent permitted by New Zealand law. We do not guarantee that the Forum will be uninterrupted, secure, or error-free.
7. Limitation of Liability

Spokes Dunedin is a volunteer-run organisation. To the maximum extent permitted by the Consumer Guarantees Act 1993 (NZ) and other applicable law, we will not be liable for any loss or damage arising from your use of the Forum, including loss of content, data, or reputation.

If our liability cannot be excluded, it is limited to NZD $50.
8. Indemnity
You agree to indemnify Spokes Dunedin against all claims, losses, and costs arising from your breach of these terms or your use of the Forum.
9. Privacy
Your use of the Forum is also governed by our Privacy Policy, available at {{Privacy Policy URL}}. We handle your personal information in accordance with the Privacy Act 2020 (NZ).
10. Termination
Either you or we may end this agreement at any time. Upon termination, your right to use the Forum ends. Sections 3, 6, 7, 8, and 11 survive termination.
11. Governing Law and Disputes
11.1 These terms are governed by the laws of New Zealand.
11.2 Any dispute arising from these terms or your use of the Forum will be resolved by the Dunedin District Court or the High Court of New Zealand, Dunedin Registry, as applicable.
12. Changes
We may update these terms from time to time. We will notify you of material changes by posting on the Forum. Continued use after notice constitutes acceptance of the new terms.
